Quit
Claim & Warranty Deed Kit
A Quit Claim Deed is one of the most important legal documents in American real
estate. If you need to transfer the ownership of real property from
one person to another, you will need to create a Quitclaim Deed (a
document that states the seller no longer has a claim to the property)
and a Warranty Deed (a document that states that the property is clear
of liens and other title issues) , along with complete instructions.
When Will I
Need A Quitclaim Deed
Despite its strange name, a quitclaim deed is a very important legal
document. When you sell real property, a quit claim deed must be
filed with the county in your state, transferring the property from
the owner to the buyer, (the new owner.) Anyone with real estate will
need one eventually.
In divorce situations, real estate necessitates a quit-claim deed. If
one person is going to keep the home, the other person will need to
quitclaim -- give up -- their portion of the home.
If you prepare a Living Trust or other estate planning tool (other
than a Last Will & Testament,) you must transfer ownership of the
real estate into the trust; to do so requires the use of a quitclaim
deed.
